Terms of Service

1. Eligibility and accounts

You must be at least 18 and legally able to enter this agreement. Keep account credentials secure and provide accurate information. Organisation administrators may manage access to organisation projects and data.

2. The service

Kinolia provides tools for generating and processing video, images, audio, captions, and related media. AI results may be inaccurate, unexpected, or unsuitable for your intended use. You are responsible for reviewing outputs before publishing or relying on them.

3. Your content and permissions

You retain your rights in content you submit. You grant Toolartech LLP a limited licence to host, copy, process, transmit, and modify that content only as needed to provide, secure, and support the service. You confirm that you have all permissions needed for submitted content, including copyright, privacy, voice, and likeness rights.

4. Generated outputs

Subject to applicable law and third-party rights, you may use generated outputs. Outputs may not be unique, and other users may receive similar material. Kinolia does not promise that an output is protectable by copyright or free from third-party claims.

5. Acceptable use

You must not use Kinolia to:

• Break the law, infringe rights, deceive, defraud, harass, or cause harm.
• Create sexual exploitation material or content involving minors.
• Use a person’s face, voice, identity, or personal data without required consent.
• Generate impersonation, deceptive political media, malware, or instructions for wrongdoing.
• Bypass safeguards, probe the service, scrape it unlawfully, or resell access without permission.

6. Credits, plans, and payments

Generation prices are shown in credits before submission. Credits are prepaid service units, not currency, and cannot be transferred or redeemed for cash except where law requires. Plan grants, top-ups, taxes, expiry, cancellation, and refund conditions shown at purchase form part of these terms. Failed generations may be automatically refunded as credits when indicated by the service.

7. Suspension and termination

We may restrict or terminate access for material breach, safety or security risk, non-payment, legal requirement, or harm to the service or others. You may stop using the service and request account deletion, subject to required record retention.

8. Service availability and warranties

The service is provided on an “as is” and “as available” basis to the extent permitted by law. We do not guarantee uninterrupted availability, particular generation results, or fitness for a specific purpose. Nothing in these terms excludes rights that cannot legally be excluded.

9. Liability

To the maximum extent permitted by law, Toolartech LLP is not liable for indirect, incidental, special, consequential, or punitive loss, or loss of profits, data, goodwill, or business opportunity. Aggregate liability is limited to amounts you paid for Kinolia in the 12 months before the event giving rise to the claim, except where such a limitation is prohibited by law.

10. Governing law and disputes

These terms are governed by the laws of India. Courts of competent jurisdiction in India will have jurisdiction, subject to any mandatory dispute rights available to you.
